Notification of free provision of services on the territory of the Republic of Bulgaria by a tour operator or a travel agent

Service provision information:

Name of the administrative service according to the Register of Services: Notification of free provision of services on the territory of the Republic of Bulgaria by a tour operator or travel agent with unique identifier 2976.

Legal basis for providing the administrative service: Art. 62 of the Tourism Act

Body issuing an individual administrative act: Minister of Tourism

Term of validity of the document/individual administrative act: According to the declared duration of the tourism activity

Requirements, procedure and documents:

In cases of free provision of services on the territory of the Republic of Bulgaria by a tour operator or travel agent, they must notify the Minister of Tourism in advance by means of a written declaration of the type and duration of the tourism activities.  The declaration is valid for the period of the free provision of services. The start and end date of the provision of the services is indicated. There is no legal limit to the period of provision of the services.

In the declaration, the persons indicate:

1. name and contact details (address, telephone, e-mail address);

2. the tourist services they wish to provide on the territory of the Republic of Bulgaria;

3. data on the availability of insurance or a guarantee covering the tour operator's liability for damages caused as a result of non-payment with its counterparties, including in the event of insolvency and bankruptcy.

The following documents must be attached to the declaration:

- a copy of the document certifying the applicant's right to carry out the relevant tourist activity according to the legislation of the country in which he is established, or indicating the normative act and the relevant legal basis by virtue of which the applicant has the right to carry out the activity;;

- a copy of a document certifying the existence of protection in the event of insolvency or bankruptcy (any protection in the event of insolvency or bankruptcy granted by a tour operator or trader facilitating the provision of related tourist services established in the territory of another member state of the European Union, in connection with the offer of tourism packages and related tourism services, is recognized as valid on the territory of the Republic of Bulgaria);   

- express power of attorney when submitted by a proxy.

The declaration is signed manually by the person representing the tour operator/tourist agent or his proxy. A declaration can also be submitted electronically, the file is signed with a electronic signature of the manager/s or a person authorized by him.

Fees: None!

In the event that information or a document is missing, the person is notified in writing to remedy the incompleteness no later than one month from the date of receipt of the notification.

Until the deficiency is removed and the authority is notified, the person cannot freely provide services on the territory of the Republic of Bulgaria.

When the free provision of services is carried out for the first time on the territory of the Republic of Bulgaria, the notification should be made within three months before the commencement of the provision of services.

After consideration and approval of the submitted documents, an individual administrative act is issued to the Minister of Tourism or a person authorized by him, regarding the exercise of free provision of services on the territory of the Republic of Bulgaria by the person requesting the service. The information is published in the Public Register of Tour Operators and Travel Agents, part of the National Tourist Register: https://ntr.tourism.government.bg/

The individual administrative act is delivered to the person representing the company or his proxy.
